Le lundi 2 décembre 2002, les deux derniers détenus de Guacimal, les syndicalistes Urbain Garçon et Jéremie Dorvil,  ont été libérés de leur emprisonnement arbitraire. Nous sommes heureux d'accueillir nos camarades une fois de plus parmi nous.

Cette mesure fait suite à notre mobilisation du vendredi 28 novembre quand nous nous sommes rendus en grand nombre au Tribunal de la Grande Rivière du Nord pour exiger du Commissaire Smith Bertrand et du Juge Maximé Jean Noël des explications concernant cette détention prolongée et leur demander la libération immédiate de nos camarades. Car au mois d'octobre écoulé, ces deux membres du corps judiciaire chargés du cas nous avaient promis une décision durant la première semaine de novembre, échéance du délai légal de trois mois pour obtenir un jugement (en comptant à partir du retour des prisonniers à laGrande Rivière du Nord). Pourtant il a fallu attendre un mois de plus et une mobilisation de plus sur le terrain pour enfin obtenir cette mesure qui s'imposait dès le départ. De nouvelles interventions solidaires au niveau international, en particulier celle de la Confédération Internationale des Syndicats Libres (CISL), ont également été importantes pour atteindre cette résolution.

Rappelons que, des onze personnes abusivement incarcérés lors des évenements de Guacimal le 27 mai 2002, les deux journalistes, Alan Deshommes et Darwin Saint Julien avaient été libéré le 8 juin, et un deuxième groupe (Alexandre Tusson, Veuséus Sénat, Mme Edouard Dambreville, Mme Lucienne Jean, Yvon Louis Jeune, Destiné Décius et Alix Roland) plusieurs mois plus tard, soit le 20 août, à la suite d'un troisième picket organisé par Batay Ouvriye et les organisations solidaires. La détention prolongée des deux principaux syndicalistes du groupe représentait, comme nous le disions alors, un signe de "la consolidation de la politique de répression anti-syndicale du gouvernement et sa volonté à présent affirmée de soumission complète aux diktats de la bourgeoisie nationale et internationale".

A l'heure actuelle, néanmoins, aucune procédure de justice n'a été entamée pour nos camarades assassinés lors des évènements (Ipharès Guerrier et Francilien Exilien), ni pour les réparations dues à toutes les victimes de cette journée tragique. Bourreaux et assassins circule touojurs en toute impunité, faisant même pression sur les membres du syndicat qui se présentent au travail pour le départ de la nouvelle récolte. Enfin, le droit syndical continue à être bafoué, la compagnie Guacimal SA persistant, comme par le passé, à refuser systématiquement de rencontrer le syndicat de l'entreprise.

Batay Ouvriye profite de l'occasion pour addresser une accolade solidaire à tous ceux qui ont participé aux luttes de soutien dans ce cas particulièrement difficile, tout en leur recommandant notre mot d'ordre :

Yesterday we found out that the two last Guacimal prisoners, the union members Urbain Garçon and Jéremie Dorvil, were released on Monday 2 December 2002 and we are happy to welcome our comrades and have them back with us.

Their release came about following our mobilisation on 28 November when a large number of us assembled at the main courthouse in Grande Rivière du Nord to demand that Commissaire Smith Bertrand and Judge Maximé Jean Noël explain the prolonged detentions and demand that our comrades be immediately released. Throughout the month of October, these two members of the judicial apparatus had been promising us a decision during the first week of November on the expiry of the legally-binding period of three months within which a judgement must be made (this period began when the prisoners were transferred from jail in Port-au-Prince to Grand Rivière du Nord). However it took another month and another mobilisation in order to get the order to let them free. New solidarity pressure from abroad, in particular from the International Confederation of Free Trade Unions, also played an important part in the outcome.

Remember that eleven people were arbitrarily detained following the events at Guacimal on 27 May 2002. The two journalists Alan Deshommes and Darwin Saint Julien were freed on 8 June, and a second group (Alexandre Tusson, Veuséus Sénat, Mme Edouard Dambreville, Mme Lucienne Jean, Yvon Louis Jeune, Destiné Décius and Alix Roland) some months later, on 20 August, following the third picket of the Justice Ministry organised by Batay Ouvriye and solidarity organisations. The prolonged detention of the two main union members from this group represented, in our opinion, a sign of "the consolidation of the government's policy of anti-union repression and of its willingness to maintain its total submission to the diktats of the national and international bourgeoisie."

As of now, no judicial procedure has begun in relation to the assassination of comrades, Ipharès Guerrier and Francilien Exilien, during the 27 May events, nor in regard to payment of damages to the other victims of that tragic day.

The torturers and murderers are still around, enjoying complete impunity, and applying pressure on the union members who are currently starting work on the new orange harvest. The Guacimal company continues to make a mockery of union rights by categorically refusing to meet with the union.
